The status of Ukrainian refugees in the EU will be reviewed: what options are European countries considering

The issue of the further stay of Ukrainian refugees in the countries of the European Union is gradually moving into the realm of political consultations, as the current mechanism of temporary protection is due to end in the spring of 2027. For Ukrainians who left abroad after the start of the full-scale war or remained there due to the inability to return home, this decision will have practical significance: legal grounds for residence, access to work, education for children, medical services and social support in the countries of residence will depend on it.

The EU is discussing the future format of temporary protection for Ukrainians

In Luxembourg, before the meeting of the EU Council on Home Affairs, the Deputy Minister of the Interior of Cyprus for Migration, Nicholas Ioannides told journalists that various ideas for further granting asylum to Ukrainian refugees are already being discussed among European states.

According to him, at this stage, EU countries should exchange positions, listen to each other’s proposals and submit their recommendations to the European Commission. No decisions are planned to be made during this meeting, as the discussion is preparatory in nature and concerns possible options for further policy.

For Ukrainians in Europe, this stage is important because the issue is gradually moving beyond general discussions about continuing support. Member States are beginning to discuss what the mechanism could be after the current period, who will be able to use it, and whether the current approach will be maintained for all categories of Ukrainian citizens.

Why the decision concerns millions of Ukrainians

The temporary protection mechanism has become the basis for legal stay for Ukrainians in the EU after the start of the full-scale invasion. Thanks to it, people have been able to quickly obtain the right to reside, get a job, send their children to school, use medical care and social services without the complicated procedure of individual consideration of an asylum application.

During the years of war, many Ukrainian families have already built a daily life in EU countries that depends on clear rules of residence. Children study in local schools, adults work, some people receive medical treatment or care for relatives, and a significant number of families still do not have a safe opportunity to return to their cities and communities in Ukraine.

The future of temporary protection is therefore of great importance for refugees. For families living between the expectation of return and the need to establish a life abroad, the EU decision will determine whether they will be able to plan the school year for their children, conclude employment contracts, continue to rent housing and use basic services without legal uncertainty.

The issue of men of military age has been brought to the public arena

During a conversation with journalists, Nicholas Ioannides was asked whether men of military age could be excluded from the category of persons entitled to temporary protection in EU countries.

He replied that there were several ideas, but no decision had been made on this matter yet. The representative of Cyprus explained that the meeting in Luxembourg is needed to discuss the different views of the member states, after which it will become clearer in which direction the further discussion can move.

This approach means that the issue remains open and does not have an approved model. For Ukrainians, this is an important detail, since any changes regarding certain categories of citizens may affect families where men are abroad with wives, children or elderly parents, as well as those who work in EU countries and support their loved ones financially.

Geographical criterion also considered among possible ideas

Another point for discussion was the geographical approach to providing protection. Journalists asked Ioannides about the possibility of applying a model similar to the Swiss practice, where the situation in certain regions of the country of origin can be taken into account when making decisions.

The representative of Cyprus noted that the issue was put on the agenda so that member states could express their views and share their assessments. He added that this option could be one of the ideas, but the EU wants to hear the positions of other countries before formulating recommendations to the European Commission.

For Ukrainian refugees, the potential discussion of the geographical criterion is sensitive, as the security situation in Ukraine is changing unevenly and the consequences of the war are not limited to the front line. A person may come from a region where there is no daily fighting, but their home may have been destroyed, their job lost, their family separated, and their return is associated with objective difficulties.

Why the EU is preparing for a review in advance

The current temporary protection mechanism for Ukrainians expires in spring 2027, so the European institutions need to determine the further format in advance. For EU countries, this issue covers migration policy, the strain on social systems, the labour market, education, housing and coordination between governments.

For Ukrainians, such preparation is important because of the need for predictability. People who are abroad due to war cannot plan their lives just a few months ahead, especially if the family includes school-age children, people with disabilities, sick relatives or family members who have already integrated into the local labour market.

The discussion in Luxembourg shows that EU countries are moving to a stage where the future format of protection needs to be thought out in advance to avoid drastic changes for people who have been living in a state of forced displacement for several years.

The statement by Nicolas Ioannides clearly indicates that no decisions will be made during the current discussion. Member States should only present their positions, after which the European Commission will be able to take them into account when preparing a document on the future mechanism.

An official decision on whether to extend temporary protection for Ukrainians and in what form it will operate after the current period expires is expected in July. Until then, Ukrainian refugees will remain on hold, as their legal stability in their host countries after spring 2027 will depend on further EU decisions.
