In Ukraine, they are planning to introduce copyrights for inventions created by the military, as this issue is currently not regulated by legislation. In the Verkhovna Rada appeared the relevant draft law.
Currently, military personnel are not subject to the general norms of labor legislation and civil service, with the exception of certain benefits during the performance of military duties. At the same time, some military units are engaged in scientific developments, the results of which can be considered objects of intellectual property.
«Therefore, there is a gap in the legislation of Ukraine in terms of legal regulation of the distribution of intellectual property rights created by military personnel during military service. The need to eliminate this gap is significantly increased in view of the realities of martial law.» — says the explanatory note.
In this regard, the deputies propose to make changes to special laws on intellectual property, adding norms related to military personnel. The draft law also provides for the settlement of issues related to the management of military inventions — who has the right to dispose of them and in what way.
Since the Ministry of Defense and other departments responsible for military formations should be able to use these developments, property rights to intellectual property are proposed to be classified as «military property».
