The war in Ukraine has been going on for almost three years, but the topic of mobilization is causing more and more discussion and excitement in society. Citizens see flagrant violations on the part of employees of territorial recruitment and social support centers (TCC), face cases of violent detention on the streets, as well as corruption in military medical commissions (MMC). All of this destroys trust in the state and creates chaos instead of an organized process of replenishment of the army.
On the one hand, mobilization is necessary for the defense of the country during a full-scale war. But it must be transparent and fair. Citizens should have a clear understanding of how the conscription system works, who is subject to mobilization and under what conditions it is carried out. However, the current situation raises many questions and complaints. A section of society is outraged that those without resources or connections are being mobilized, while representatives of the political elite, business, show business and the media are left out of the process. As a result, there is an impression of injustice that undermines the morale of those already at the front and demotivates potential recruits.
In response to public dissatisfaction, a draft law was registered in the Verkhovna Rada, which provides for criminal liability for employees of the TCC and VLK for violating the mobilization rules.
Draft law on liability of TCC employees: what will change?
On January 27, draft law No. 12442 appeared on the parliament’s website, which provides for punishment for officials of the TCC and military medical commissions for illegal conscription, corruption, falsification of medical documents and other abuses of power.
One of the initiators of the draft law, People’s Deputy from «Servant of the People» Oleksandr Kachura, explained, that this document should put an end to the chaotic «busification» of Ukrainians, when people are forcibly detained on the streets, used physical force on them and even kidnapped. He emphasized that such mobilization has nothing to do with the law and only destroys trust in state institutions. The People’s Deputy also reminded that President Volodymyr Zelenskyi had previously stated the need for legislative regulation of the actions of TCC employees in order to prevent cases of forced conscription on the streets.
«Together with my colleagues, I initiated a draft law that will put an end to the aggressive «busification» of Ukrainians! Beatings, gassing, kidnapping people on the streets are not mobilization, but chaos that destroys trust in the state.
It is clear that mobilization during a full-scale war is necessary. But it must be fair! I personally helped recruit the soldiers of the 3rd assault division. They do it really well. We visited prisons together, offered motivated people to join the ranks of the Armed Forces. Nobody was pulled by force!
The President of Ukraine, Volodymyr Zelenskyy, said that a draft law was needed so that the TCC would not have a chance to walk the streets and catch people. And we are trying to do it. Colleagues worked out such a proposal.
What does the bill propose? Up to 8 years of imprisonment for officials of the TCC and VLK for illegal conscription or dismissal from the army, falsification of medical examinations and abuse of power. Also, responsibility for corruption among military medics is increasing.
In my opinion, the staffing of the army should be a matter for civilians or the brigades themselves, and not for people who arrange hunting for Ukrainians!», — said Kachura.
Zhorin: mobilization should concern everyone
In addition, the deputy commander of the 3rd separate assault brigade of the Armed Forces of Ukraine Maksym Zhorin spoke about the unfair mobilization. According to him, the problem lies not only in violations by the TCC, but also in the fact that mobilization is not fair for all categories of the population.
Zhorin emphasizes that not only motivated volunteers and those who could not «buy» armor should fight. The military emphasizes that representatives of all social strata, including children of politicians, officials, famous bloggers and representatives of show business, should bear equal responsibility before the state.

People are not idiots, and they see how nothing has changed in the life of the so-called «elite». Accordingly, it is quite difficult to motivate them to join the army.
Of course, those who live in the «let the children of deputies fight» paradigm will find hundreds more excuses for their cowardice and indifference. However, this does not negate the need to remove the category of Ukrainians who for some reason were not created for the army.

The mobilization problems that are troubling Ukrainian society today are the result of an imperfect system and a lack of justice. Adoption of the new draft law may partially solve the issue of illegal actions of TCC employees, but it will not change the main thing — inequality between citizens.
Mobilization during war must be an organized process based on clear laws, equality and transparency. This is the only way to preserve citizens’ trust in the state and ensure fair protection of the country.
