Business calls on state bodies to adopt legislative changes to continue testing the “eExcise” system

Entrepreneurs appealed to state authorities to initiate and adopt amendments to Law No. 3173-IX on the implementation of the eExcise system by October 1, 2025, in order to extend the testing period and ensure its proper implementation. About this it is said in a message on the website of the Ukrainian Association of Tobacco Manufacturers “Ukrtyutyun”.
A working meeting between business associations, relevant ministries, manufacturers and importers of excise goods was held in the Parliamentary Committee on Finance, Tax and Customs Policy. The participants discussed the difficulties associated with the implementation of the electronic system of traceability of excisable goods “eAkcyz”, and entrepreneurs expressed concern about the system’s unreadiness for full testing and the extremely short period of its implementation.
“Business representatives warned that without legislative changes that will provide a sufficient period for testing all components of the eExcise system, from January 1, 2026, there is a risk of interruptions in the supply of legal products, the growth of the shadow market and significant losses of the state budget – more than UAH 400 million daily, which is unacceptable in the conditions of martial law.” – it is emphasized in the message.
“Ukrtyutyun” summarized that the business expects from the authorities certain deadlines for the adoption of the necessary legislative changes and the completion of the development of a full-fledged version of “eExcise”. According to the association, this approach will allow the system to perform its main task, give businesses time to adjust, reduce the risks of technical failures, preserve the stability of tax revenues and prevent the growth of the shadow economy.
It will be recalled that on June 26, business associations already appealed to the government with the demand not to launch the Electronic System of Circulation of Alcoholic Beverages, Tobacco Products and Liquids for Electronic Cigarettes (“eExcise”) without proper preparation. The appeal was joined by the American Chamber of Commerce in Ukraine (AmCham), the European Business Association (EBA), the associations “Ukrtyutyun” and “Ukrgorilka”, the Ukrainian Food Retail Alliance, and the Union of Ukrainian Entrepreneurs (SUP).
In the appeal, it was recalled that according to the current law, the government had to adopt relevant by-laws by January 27, 2024 and start testing the system from March 1, 2025. Instead, these documents have not yet been adopted, and the schedule of the Ministry of Digital Transformation envisages preparing the system for a productive launch only at the end of 2025 – without software solutions for working in offline mode. Experts point out that such a situation contradicts the requirements of Law No. 3173-IX, complicates timely business preparation, creates technical threats and causes operational uncertainty.
