The Law of Ukraine entered into force №3680-IX “On Amendments to Some Legislative Acts of Ukraine Regarding Labor Regulation of Domestic Workers”. This law entered into force three months after its official publication, introducing important changes in the legal status and working conditions of domestic workers in Ukraine.
According to the new law, a domestic worker is an individual who performs domestic work within the framework of employment relations with an employer. Domestic work is defined as work performed for a household on the basis of an employment contract. It is important to note that work that is performed irregularly and does not exceed 40 hours per month is not considered domestic work in the context of this law.
The law establishes age restrictions for domestic workers: persons under the age of 16 cannot be hired for such work. This provision is aimed at protecting the rights of minors and ensuring safe working conditions.
In addition, the law regulates a number of important aspects related to the employment of domestic workers, in particular:
- legal status of domestic workers: The law defines the legal status of such workers and regulates their labor relations with employers.
- rights, obligations and guarantees: Establishes additional rights, obligations and guarantees for domestic workers who live in the housing of the household where they work.
- working time and rest: The law clearly regulates the working time and rest time of domestic workers, ensuring the protection of their rights to adequate rest.
- Termination of an employment contract: The specifics of terminating an employment contract with a domestic worker are separately defined, which helps to avoid possible conflict situations.
- monitoring of compliance with legislation: The law also establishes special conditions for monitoring compliance with labor legislation for domestic workers, which aims to ensure their rights and interests.
The introduction of this law is an important step in protecting the rights of domestic workers in Ukraine and ensuring their labor rights in accordance with international standards.
