Language Ombudsman calls for ban on public performance of songs in Russian

In Ukraine, there is a public demand for a legislative ban on the public performance of songs in the Russian language. About this stated Olena Ivanovska, Commissioner for the Protection of the State Language.

She emphasized that this issue needs a clear legal settlement, as currently Ukrainian legislation does not provide for such a ban.

“According to the Law of Ukraine “On Ensuring the Functioning of the Ukrainian Language as the State”, the language of cultural events in Ukraine is the state language (Article 23). However, the Law does not exclude the possibility of using other languages during the performance of artistic works – in particular songs – provided that this does not contradict other legislative norms. That is, the performance of songs in Russian in public space as such is not a violation of the Law on the State Language.” Ivanovska explained.

The language ombudsman also noted that during a full-scale war, the public performance of songs in the Russian language causes a sharp negative reaction in most citizens. She emphasized that now Ukrainian society is forced to fight not only for territories, but also for symbols, language and national identity.

“The stage and the street are also spaces of meaning, and they should sound Ukrainian.” Ivanovska added.

She also reminded that in some cities of Ukraine, in particular in Kyiv and Ternopil, local authorities have decided to ban the public performance of Russian-language songs. At the same time, as Ivanovska emphasized, no liability is foreseen for such violations.

“In addition to public support, such initiatives require state-wide regulatory support, legal certainty: both for local self-government bodies, and for performers, organizers of events, business entities.” Ivanovska emphasized.
