The Verkhovna Rada increased liability for corruption offenses

On June 17, the Verkhovna Rada of Ukraine increased responsibility for corruption offenses, informs People’s Deputy from the faction “European Solidarity” Iryna Gerashchenko.

“245 People’s Deputies supported changes to the Criminal Procedure Code, the Criminal Code on increasing responsibility for corruption offenses No. 13271-1”, – noted Gerashchenko.

The amendments provide that liability under Article 172-6 of the Code of Administrative Offenses for the submission of knowingly inaccurate information in the declaration of a person authorized to perform the functions of the state or local self-government regarding property or another object of declaration that has a value arises in the event that such data differ from reliable data by the amount of 150 to 750 subsistence minimums for able-bodied persons. Therefore, the threshold for incurring criminal liability for false declaration for officials is increased to UAH 2.271 million.

Thus, in part 1 of Article 366-2 of the Criminal Code “Declaration of unreliable information” it will be established that criminal liability for the intentional introduction of knowingly unreliable information by the subject of the declaration to the declaration occurs if this information differs from the reliable information by an amount from 750 to 2,500 subsistence minimums.

The sanction increases the maximum fine for such an offense — from UAH 68,000 to UAH 102,000. Part 2 of Article 366-2 of the Criminal Code also increases the threshold amount of false declaration, for which liability is provided, and also increases the amount of the fine.

Thus, the deliberate entry by the subject of the declaration of knowingly inaccurate information into the declaration of a person authorized to perform the functions of the state or local self-government, provided for by the Law “On Prevention of Corruption”, if the amount of deviations exceeds 2,500 subsistence minimums (7.57 million UAH), is punishable by a fine from 102,000 UAH to 136,000 UAH, community service for a period of 150 to 240 hours, or restriction of freedom for a term of up to 2 years, or deprivation of liberty for the same term with an additional punishment in the form of a ban on holding certain positions or engaging in certain activities for a term of up to 3 years.
