Gambling advertising has been banned in Ukraine, but there are exceptions

In Ukraine since April 1 acquired a law prohibiting the advertising and sponsorship of gambling is in force. At the same time, only some of its provisions are currently in effect.
The document envisages the creation of a new gambling industry management body – “PlayCity”, which will replace the Commission for the Regulation of Gambling and Lotteries (KRAIL). This body will be finally liquidated. Among the innovations is the transition to a controlled game system instead of traditional checks, as well as the introduction of mechanisms for blocking illegal gambling sites and mobile applications.
Gambling advertising is prohibited almost entirely, except in certain cases:
- on television and radio from 23:00 to 06:00;
- in media aimed at an audience over 21 years old;
- on online platforms and search engines with a target audience of 21 and over.
Sponsorship is also prohibited, with the exception of supporting sporting events. Offering free bonuses, participation of military personnel, volunteers and public figures in advertising campaigns, as well as the use of military themes are prohibited.
The law establishes mandatory blocking of illegal sites, tightens requirements for gambling organizers and prohibits obtaining a license for persons with tax debts. Payments must be made exclusively in cash through bank accounts.
Lotteries are also subject to most of the restrictions imposed on gambling businesses. Separately, the law defines requirements for the impeccable reputation of officials, the presence of tax obligations, and prohibits relations with the aggressor state. In addition, limits on spending and playing time, mandatory breaks, and a system of “control purchases” with video recording are being implemented. It is forbidden to accept bets on credit.
Law No. 4116-IX, signed by Volodymyr Zelenskyi, also provides for additional restrictions on the activities of online casinos. The decision of the National Security Council on this matter will enter into force on April 20, 2024.
