Head of Odesa Regional Administrative Court defends right to prosecutor’s pension in court

The former head of the Kyiv City Prosecutor’s Office, and now the head of the Odesa Regional Military Administration, 44-year-old Oleg Kiper, last year sought through the court to recalculate his length of service and award a pension for years of service as a prosecutor. As writes Obozrevatel, Kiper filed an administrative lawsuit against the Main Directorate of the Pension Fund in Chernivtsi region, after which he was denied a pension.

The trial ended with partial satisfaction of his claim, and the Kyiv District Administrative Court officially recognized Oleg Kiper as a pensioner. The decision was made by judge Victoria Lysenko.

Kiper worked as the head of the Kyiv City Prosecutor’s Office from September 2020 to May 2023. It was during this period that he filed a lawsuit, justifying his demand by the fact that the Pension Fund in Chernivtsi refused to calculate his pension on February 13, 2023. The reason for the refusal was that the Pension Fund did not include three periods of study at the Odesa Law Academy — in 2001, 2002 and 2018 — as part of his seniority. According to the legislation, in order to receive a pension, Kiper had to have 25 years of experience, of which at least 15 years he had to work in the prosecutor’s office. However, the Pension Fund at that time estimated his length of service at 23 years, 3 months and 14 days, of which 21 years, 3 months and 22 days are work in various positions.

The court resolved the dispute by adding to Kiper’s work experience his periods of study at the full-time department of the Faculty of Law. This made it possible to increase his seniority to the required 25 years, 3 months and 3 days, which was enough for the appointment of a pension.

Thus, on August 7, 2023, the Kyiv District Administrative Court obliged the Main Department of the Pension Fund of Ukraine in Chernivtsi region to award Oleg Kiper a pension for years of service, starting from February 6, 2023, in accordance with Article 86 of the Law of Ukraine “On the Prosecutor’s Office”.
