The Cabinet of Ministers approved the procedure for counting the period of work abroad towards the insurance period

Cabinet of Ministers of Ukraine confirmed a new procedure regulating the consideration of periods of work abroad when determining the right to an old-age pension if a person does not have the necessary insurance experience in Ukraine.

Resolution No. 562 defines the mechanism of confirmation and inclusion of foreign work experience in the insurance experience, provided that this period has already been recognized as such according to the legislation of the country where the person worked. This rule applies if an international agreement in the field of pension provision has been concluded between Ukraine and the relevant state.

Persons who apply for a pension, but have worked abroad and do not have sufficient experience in Ukraine, must submit an application for the appointment of a pension to the Pension Fund together with supporting documents regarding work in another state. If these documents do not provide an opportunity to confirm seniority, or if they are missing, the territorial body of the Pension Fund sends a request to the Ministry of Foreign Affairs of Ukraine within five working days from the moment of receiving the complete package of documents. The Ministry of Foreign Affairs, in turn, transfers it through diplomatic channels to the relevant institution of another state, which deals with pension payments.

If the exchange of information between countries is not possible at the time of submission of the application, the request is sent after this possibility is restored. The received supporting documents are recognized as valid in Ukraine, provided they are legalized in accordance with the legislation, unless otherwise determined by an international agreement. After receipt of the documents, the periods of work specified in them are included in the insurance length of service in the calendar calculation.

In addition, the Cabinet of Ministers approved the procedure for confirming the fact that another state does not make pension payments to persons living in Ukraine for the periods of work before January 1, 1992 outside of Ukraine — in the republics of the former USSR. Such periods may be included in the insurance period under the terms of an international agreement concluded with the relevant state.
