The Ministry of Health has clarified the procedure for determining the cause of disability for victims of explosive devices

Ministry of Health of Ukraine provided clarification on the procedure for determining the cause of disability for people who were injured by explosive objects. The updated daily functioning assessment system provides for the determination of the cause of disability for persons who have suffered health damage as a result of the action of explosives, ammunition or military weapons, based on the submitted documents.
In such cases, there are two options for establishing the cause of disability, depending on which confirmation the person provides – an extract from the Unified Register of Pretrial Investigations or a decision of the Interdepartmental Commission under the Ministry of Veterans Affairs of Ukraine.
If a person submits an extract from the EDPR, the expert team determines the cause of disability as an injury or other health damage received from explosive objects. After that, the person has the right to apply to the social security authorities for compensation in accordance with the Law of Ukraine “On Mine Action in Ukraine” and Resolution of the Cabinet of Ministers No. 1020.
In the case of submission of a decision of the Interdepartmental Commission, the expert team establishes another cause: injuries (contusions, traumas, mutilations), diseases or other damage to health, received during an anti-terrorist operation or measures against the military aggression of the Russian Federation against Ukraine.
For a civilian injured by explosive objects, the procedure is clearly defined. First, an assessment of daily functioning is carried out, on the basis of which disability is established. If a person submits an extract from the EDPR, the cause of disability is defined as health damage due to explosive objects.
Further, a person can apply to the Interdepartmental Commission to obtain the status of “person with a disability as a result of war” in accordance with the law “On the status of war veterans, guarantees of their social protection”. After receiving the commission’s decision, it has the right to re-apply to the expert team to review the cause of the disability. In this case, the cause can be changed to wounds or other injuries received during anti-terrorist operations or measures against Russia’s military aggression.
All decisions regarding the causes of disability are made solely on the basis of the provided documents – an extract from the EDPR or a decision of the Interdepartmental Commission. These documents are the basis for establishing the cause of disability.
