Former head of Berdyansk port sentenced to 4 years in prison for procurement fraud

The former head of the Berdyansk branch of the state enterprise “Seaports Administration of Ukraine” was sentenced to four years in prison for fraud related to procurement. At the same time, his accomplice was sentenced to three years in prison. There was a verdict announced On May 19, the Appeals Chamber of the High Anti-Corruption Court, which canceled the previous acquittal.
The message does not mention the names of the convicts, however informs publication “Word and Deed”, it is about Oleksandr Barchan and the former director of the Dnipro branch of the Kharkiv assembly and production enterprise “Elektropivdenmontazh” Nataliya Panchenko.
The press service of the court reported that the decision entered into force from the moment it was announced, and the convicts were immediately taken into custody in the courtroom. At the same time, it can be appealed to the Criminal Court of Cassation as part of the Supreme Court.
Barchan was accused of abuse of office and official forgery during procurement in 2018-2019. He was accused of 2 Art. 28, ch. 2 Art. 364 and ch. 1 Art. 366 of the Criminal Code of Ukraine. According to the case file, Panchenko acted as an accomplice in the abuse of her official position and also committed official forgery.
In November 2022, the High Anti-Corruption Court of First Instance acquitted Barchan due to lack of sufficient evidence of guilt, and sentenced Panchenko to one year of imprisonment for official forgery, exempting her from punishment due to the expiration of the statute of limitations.
However, the appellate court issued a new sentence: Barchan was found guilty and sentenced to four years in prison with an additional ban on holding certain positions for three years and a fine of 8,500 hryvnias. Panchenko was sentenced to three years of imprisonment with a similar ban on holding positions and the same fine.
