“Servants of the People” want to allow deputies to hold positions in the Cabinet of Ministers

Representatives of the “monomajority” took the initiative to allow people’s deputies to combine work in the parliament with a position in the Cabinet of Ministers. Verkhovna Rada registered draft law No. 13304, the authors of which are deputies from the “Servant of the People” faction — Galina Tretyakova, Vitaly Bezgin, Andriy Klochko, Igor Vasiliev, Oleg Bondarenko, Maksym Pavlyuk, and Oleksandr Fedienko.
The explanatory note to the project states that the current version of the law “On the Status of the People’s Deputy of Ukraine” is based on the legal position of the Constitutional Court formulated back in 2002. According to her, the combination of a deputy’s mandate with work in executive bodies, in particular in the Cabinet of Ministers, was recognized as contradicting the principle of separation of powers.
“At the same time, the current Constitution of Ukraine does not directly prohibit a People’s Deputy of Ukraine from being a member of the Cabinet of Ministers, and the very legal position of the Constitutional Court was formed under circumstances and a political system that are significantly different from the current conditions.”, – believe the authors of the draft law.
In this regard, they propose to allow people’s deputies to hold the positions of prime minister, first deputy prime minister, deputy prime minister, minister, first deputy and deputy minister. According to the initiators, such changes do not contradict the Basic Law, “are consistent with the doctrine of separation of powers and the principle of political responsibility, and also take into account European democratic practices.”
