The High Court for Intellectual Property will be liquidated in Ukraine

The Supreme Court on Intellectual Property and its Appellate Chamber will liquidated due to the lack of need for their functioning. The corresponding decision is planned to be adopted after the approval of the Strategy for the Development of the Justice System and Constitutional Judiciary until 2029.
Director General of the Legal Policy Directorate of the Office of the President, Viktor Dubovik, said that during the discussion of the provisions of the Strategy, consultations were held with the Chairman of the Verkhovna Rada, Ruslan Stefanchuk. He presented arguments regarding the impracticality of the High Court on Intellectual Property. According to him, the statistics of consideration of cases of this category in Ukrainian courts were analyzed.
“After analyzing the statistics of cases, the question arose as to whether this court will have a load at all, that is, whether this court will have work. Now the prevailing opinion is that there is no need for this court to exist at all.” Dubovik noted.
We would like to remind you that the High Court on Intellectual Property (IP-Court) and its Appellate Chamber were created on September 29, 2017 as part of the judicial reform initiated by President Petro Poroshenko. In 2017-2018, competitions were announced for 21 vacant positions of judges of the first instance of this court and for 9 positions of judges of its Appellate Chamber.
However, the process did not progress beyond the stage of the qualifying exam, and in the fall of 2019, the powers of the members of the VKKS were terminated. Because of this, the IP Court never started the procedural activity.
