Zelenskyy enacts NSDC decision on corruption offences in establishing disability for state officials
President of Ukraine Volodymyr Zelenskyy signed decree, which implemented the decision of the National Security and Defense Council (NSDC) dated October 22, 2024 “Regarding combating corruption and other offenses during the establishment of disability for officials of state bodies”.
According to the decree, the Prosecutor General’s Office, SBU, SBU, National Police and NABU must report within a month on the measures taken to identify violations in the process of establishing the disability of officials. After these inspections, the specified bodies must make appropriate personnel decisions.
The Cabinet of Ministers has been instructed to create working groups to check the decisions of the MSEK regarding the disability of officials and to report on the results of these checks within three months. Also, the Cabinet of Ministers should develop a plan for digitalization of all stages of work of MSEK in cooperation with the Ministry of Health and the Ministry of Digital Transformation. In addition, it is necessary to conduct an audit of pension payments to officials together with the Pension Fund, SBU, SBU and the National Police.
The Ministry of Health of Ukraine, together with the Ministry of Digital Transformation of Ukraine, is tasked with preparing and submitting to the Cabinet of Ministers of Ukraine within two weeks a digitalization plan for the passage of all stages of medical and social expert commissions.
It is recommended that the Verkhovna Rada, together with the Ministry of Health, prepare a draft law on reforming the system of medical and social expertise within a month, which provides for the liquidation of MSEK from the end of 2024.
The National Agency for the Prevention of Corruption is tasked with checking by November 30, 2024, the state of implementation of the recommendations identified in the study “Top 10 corruption risks of medical and social expertise regarding the establishment of disability”, which was conducted in 2021, to update it taking into account the legal regime of martial law and take into account during the development of the new Anti-Corruption Strategy.
The decision of the National Security Council also provides for amendments to the Criminal Code of Ukraine, which will make it possible to bring the heads and members of the MSEK to criminal liability for illegal enrichment.
In his evening address, Zelenskyi emphasized the importance of digitalization of all stages of work on establishing disability for real changes in this area. He also emphasized the need for personal responsibility and personnel decisions in the central authorities that control the activities of MSEK. The President stated that the decision of the National Security Council provides for a full audit of pensions and other payments to officials who used the system to organize their disability.
