Environmental Prosecutor’s Office ensures protection of unique territories of Trukhaniv and Venetian Islands
The Specialised Environmental Prosecutor’s Office of the Prosecutor General’s Office cancelled illegally established water protection zones and 100-metre coastal protection strips on the Trukhaniv and Venetian Islands in Kyiv. From now on, the entire territory of these islands has been granted the status of a coastal protection zone, which imposes strict restrictions on any economic activity.
The Kyiv Commercial Court upheld the environmental prosecutor’s claim, and the decision was confirmed by the Northern Commercial Court of Appeal and the Supreme Court. The courts upheld the prosecutor’s arguments, which stressed that under Ukrainian land and water legislation, the entire territory of Trukhaniv and Venetian Islands should be protected.
The pre-established water protection zones greatly simplified the protection regime for these areas, in particular, allowing for capital development. At the same time, the 100-metre coastal protection zones created the illusion that the rest of the territory was not subject to protection.
