How many administrative protocols were issued by the TCC, how many Ukrainians were wanted: comments and conclusions

According to the Ministry of Defense, since the beginning of the full-scale invasion, TCC employees have drawn up more than 180,000 administrative protocols for persons who violated the rules of military registration. In addition, more than 400,000 notices were filed on the search for persons who evade service. This was the response to the request from the Ministry of Defense lawyer Roman Lykhachev.

The number of protocols drawn up by TCCs in Ukraine

According to the Ministry of Defense, in 2022 TCC employees drew up 55,680 protocols for violating the rules of military accounting and damage or loss of military accounting documents due to negligence. The largest number of such violations was recorded in Zhytomyr Oblast (about 4.9 thousand), Kyiv (4.25 thousand), Volyn Oblast (4.1 thousand) and Zakarpattia Oblast (4 thousand). The total amount of fines imposed on violators amounted to 49.29 million hryvnias.

In 2023-2024, the number of administrative protocols drawn up under the relevant articles increased significantly. Over the course of a year and a half, 130,100 such protocols were drawn up across Ukraine for violators who paid fines in the amount of 150.3 million hryvnias. The largest number of protocols was drawn up in Lviv Oblast (20.5 thousand), Zakarpattia Oblast (14.6 thousand) and Dnipropetrovsk Oblast (almost 10.2 thousand).

The number of people declared wanted by the TCC

According to the Ministry of Defense, in 2022, 100,500 reports on the search for persons evading military conscription were registered in Ukraine. Of them, 21,600 are in Ternopil Oblast, almost 15,900 in Lviv Oblast and 12,300 in Ivano-Frankivsk Oblast. In 2023 and the first half of 2024, the number of wanted reports for persons who violated military registration rules tripled, reaching 316,000.

Among the regions with the highest indicators are Lviv Oblast (85.8 thousand), Zakarpattia Oblast (54.2 thousand), Ivano-Frankivsk Oblast (33.3 thousand), Ternopil Oblast (28.7 thousand) and Khmelnytsky Oblast (20.5 thousands).

In 2022, TCC employees drew up more than 4,200 administrative protocols for violators of military registration in the amount of more than 3,900 hryvnias. Also, 638 applications for criminal violations and about 2,800 wanted reports were registered. In 2023-2024, the number of completed administrative protocols decreased to 3,300. The amount of fines imposed on violators amounted to 3.1 thousand hryvnias. The number of registered applications for criminal violations decreased to 466. At the same time, the number of wanted reports increased to 11,400.

The number of protocols drawn up by the TCC in the Kharkiv region

In 2022, TCC employees issued more than 3,500 administrative protocols for violators of military registration in the amount of more than three thousand hryvnias. Also, 283 applications for criminal violations and about 2,300 wanted reports were registered. In 2023-2024, the number of completed administrative protocols increased to four thousand. The amount of fines imposed on violators amounted to 4.8 thousand hryvnias. The number of registered applications for criminal violations increased to 527. At the same time, the number of wanted reports increased to 2,500.

The number of protocols drawn up by the TCC in the Lviv Region

In 2022, TCC employees issued more than 1,900 administrative protocols for violators of military registration in the amount of more than 4,100 hryvnias. Also, 15,816 applications for criminal violations and about 15,800 wanted reports were registered. In 2023-2024, the number of completed administrative protocols increased to 20.5 thousand. The amount of fines imposed on violators was 31.4 thousand hryvnias. The number of registered applications for criminal violations decreased to 8,582. At the same time, the number of wanted reports increased to 85,800.

Comments on the situation with administrative protocols and the search for persons who violated the rules of military registration

Mykola Knyazhytskyi, People’s Deputy:

“The state leadership must treat people with respect during mobilization. At the same time, Ukraine has a high percentage of those who are ready to defend the Motherland.

Our Deputy Minister of Defense Kalmykova said that they are very satisfied with the way recruiting is going, that one third of all those who are mobilized here are people who came voluntarily – this is a very high percentage. Similarly, 50% of Ukrainian men say that they are ready to defend the Motherland, or women who are also ready to defend the Motherland, and this is a very high percentage. In Poland, it is 15%. If people were told absolutely calmly: there are two months, as it was said in the law until July 18, when you can update the data, because the updated data assumes that there is your actual address, bank account. If you don’t do this, you don’t appear on the summons, you hide, then obviously there is a criminal responsibility for this, but you have two months to do it

Mobilization is a very unpopular issue. Although the army needs many more men, no one wants to take responsibility for mobilization. President Zelensky points to the government ministries, which in turn say that this is a matter for the parliament. This becomes a real problem. People are even afraid to buy real estate in order to avoid possible confiscation of it in the event of the adoption of the legislation.” Knyazhytskyi said on Espresso.

Roman Likhachev, lawyer:

“There are approximately 5-6 million people in Ukraine who can be called up for military service. However, after excluding those who have updated their information, as well as active military personnel, there remains a significant number of potential violators. If you fine that many people at least once, it will take tens, if not hundreds of years. Ukrainian courts are currently facing a serious shortage of personnel. Some of them are overloaded due to the transfer of cases from institutions located in the occupied territories or in the zone of active hostilities. In addition, the courts are overloaded with cases involving war crimes. In order to impose fines on all violators, it is necessary to increase the number of employees both in the TCC and in the courts.”

Many Ukrainians try to avoid the draft, even risking prison terms and large fines. Since the beginning of the war, 13,600 people have been detained trying to cross the border outside checkpoints, and another 6,100 people with forged documents.

Such a large number of those unwilling to fight shows serious systemic problems in the state sphere. The unfairness of mobilization and reservation, insufficient information campaign, inefficiency of control over the execution of military registration cause mass evasion. In addition, there are numerous corruption schemes that allow you to avoid the draft in many ways.

Military service should be transparent and understandable for all citizens. It is necessary to reform the accounting system, ensure the protection of human rights and implement support mechanisms for servicemen and their families. Currently, the current legislation restricts the rights and freedoms of citizens, instead of creating incentives for military service. The government should focus on improving conditions for the military, not on increasing punishment.
