NABU and SAP reported new suspicions regarding the illegal departure of men abroad

Detectives claim that during 2022-2023, more than 1,000 similar decisions were made in one of the district courts of Odesa. 

NABU and SAP informed about the suspicion of five more people involved in the case of the judge of the Bilhorod-Dnistrovsky city-district court of Odesa region Oleksandr Boyarskyi, who is suspected of bribery for making a decision on permission to leave the country for a man conscripted for military service. According to edition “Word and Deed” with reference to its own sources, one of the suspects is lawyer Stanislav Klymenko.

“Under the procedural guidance of SAP prosecutors, NABU detectives exposed five more people involved in the establishment of a criminal scheme of illegal departure of men of conscription age to avoid mobilization,” – informs SAP.

As of today, the suspicion has been reported:

  • to a lawyer – according to Part 3 of Art. 369, Part 3 of Art. 332 of the Criminal Code of Ukraine;
  • to his assistant – according to part 5 of Art. 27, Part 3 of Art. 332 of the Criminal Code of Ukraine;
  • to the intermediary – according to Part 3 of Art. 369, Part 5 of Art. 27, Part 3 of Art. 369 of the Criminal Code of Ukraine;
  • to the secretary of the court session – according to Part 3 of Art. 369 of the Criminal Code of Ukraine;
  • to the court consultant who was responsible for the distribution of cases – according to Part 2 of Art. 376-1 of the Criminal Code of Ukraine.

It is also known that the NABU and SAP reported the suspicion to Oleksandr Boyarskyi, judge of the Bilhorod-Dnistrovsky City District Court of the Odesa Region. According to the investigation, the scheme provided for the issuance of court decisions to establish the place of residence of a minor child with the father, so that he would use such a decision as a basis for going abroad with her. “Clients” were sought in groups on social networks, and the cost of each court decision was from 1,500 to 3,500 US dollars.

Detectives established that during 2022-2023, more than 1,000 similar decisions were made in the said district court. There were cases of men traveling abroad unaccompanied by a child, determining the child’s place of residence in the temporarily occupied territory, forging procedural documents from plaintiffs, and interfering with the system of automated distribution of court cases. Currently, one of the judges is documented to have been given an undue advantage of $1,500 for promising to make the “necessary” decision.

The investigation is ongoing and law enforcement continues to work to identify and prosecute all those involved in this criminal scheme.
