The President of Ukraine introduced a bill on payments to military personnel who perform tasks outside the borders of our country, including on the territory of the Russian Federation
President of Ukraine Volodymyr Zelenskyy submitted to the Verkhovna Rada bill No. 11483, which concerns guarantees of payments to military personnel performing tasks outside Ukraine, in particular on the territory of the Russian Federation.
According to this draft law, amendments are made to Article 3 of the Law “On Social and Legal Protection of Servicemen and Members of Their Families”, which are aimed at avoiding ambiguous interpretation and application of the provisions of this law in practice.
The draft law provides that the Law applies to servicemen of the Armed Forces of Ukraine, other military formations formed in accordance with the legislation of Ukraine, special law enforcement agencies, special state agencies with law enforcement functions, the Foreign Intelligence Service of Ukraine, the intelligence agency of the Ministry of Defense of Ukraine, the intelligence agency of the Central the executive power body, which implements the state policy in the sphere of state border protection, the State Service of Special Communication and Information Protection of Ukraine (hereinafter referred to as military formations, law enforcement and intelligence agencies), which perform military service on the territory of Ukraine.
The law also applies to servicemen of the above-mentioned military formations, law enforcement and intelligence agencies – citizens of Ukraine who perform military duty outside Ukraine, including on the territory of the Russian Federation during their direct participation in the implementation and/or ensuring the implementation of measures necessary for ensuring the defense of Ukraine, protecting the safety of the population and the interests of the state in connection with armed aggression against Ukraine, as well as their family members.
The explanatory note to the draft law states that the implementation of the relevant Law will not require additional financial costs from the state budget. The draft law does not require approval by state authorities.
In addition, it is noted that the adoption of the law will contribute to ensuring the same interpretation and application in practice of the provisions of the Law of Ukraine “On Social and Legal Protection of Servicemen and Members of Their Families”, which, in turn, will make it impossible to narrow the guarantees of social and legal protection of a separate category of servicemen and members their families, in particular those military personnel who perform military duty on the territory of the aggressor state during their direct participation in the implementation and/or ensuring the implementation of measures necessary to ensure the defense of Ukraine, the protection of the safety of the population and the interests of the state in connection with the armed aggression against Ukraine.
We will remind, in his address to Ukrainians, the President of Ukraine emphasized that it is necessary to provide clear guarantees at the legislative level for Ukrainian soldiers who participate in the Kursk operation, for example, and will participate in other actions on the territory of the Russian Federation. He noted that this should be enshrined in law so that all our people have confidence that the state will act accordingly.
