The Verkhovna Rada adopted a draft law on punishment for the heads of the TCC and members of the Military Medical Commission

On March 12, the Verkhovna Rada adopted draft law No. 12442 in the first reading, which provides for the introduction of criminal liability for violations of legislation in the field of defense, mobilization training and mobilization committed by the heads of the TCC, as well as the heads and members of the VLK. Legislators propose to introduce punishment in the form of deprivation of liberty for a term of 2 to 5 years for willful violation of the procedure for conducting a medical examination to determine fitness for military service based on health. This applies to cases when the violation led to the conscription of a person who was not subject to conscription, or to wrongful exemption from conscription, referral or dismissal from military service due to health.

In the case of a repeated violation, committed by a group of persons with a prior conspiracy or during a special period (except for martial law), it is proposed to establish a punishment in the form of imprisonment for a term of 3 to 6 years with an additional restriction of the right to hold certain positions or engage in certain activities for a term of 1 to 3 years.

For similar violations committed under martial law, a more severe punishment is prescribed – imprisonment for a term of 3 to 8 years with a ban on holding certain positions or engaging in certain activities for 1-3 years.

In addition, Article 426(2) “Violation by a military official of the order of conscription (acceptance) of citizens for military service” provides for the establishment of punishment for a violation that led to the illegal conscription of a person who is not subject to conscription by law, or to evasion or illegal dismissal from service.

In such cases, punishment in the form of service restriction for a term of up to 2 years, detention in a disciplinary battalion for the same term, or imprisonment for up to 5 years is proposed. If these violations were committed during a specific period, the penalty is imprisonment from 3 to 6 years with a ban on holding certain positions or engaging in certain activities for a period of 2 to 3 years.

If the offenses were committed during martial law, it is proposed to establish a punishment in the form of deprivation of liberty for a period of 3 to 8 years with an additional limitation of the right to hold certain positions or engage in certain activities for a period of 1 to 3 years.
