The Verkhovna Rada plans to grant a deferment from mobilization to lawyers under certain conditions
In the parliament registered Draft Law No. 12348, which provides for amendments to Article 23 of the Law “On Mobilization Training and Mobilization”. The project proposes to provide some lawyers with a deferment from conscription for military service during mobilization.
The idea of the draft law is to supplement Part 1 of Article 23 with a new clause exempting lawyers from mobilization under certain conditions. In particular, this applies to those who have at least 10 years of continuous experience as a lawyer, timely pay fees for the provision of lawyer self-governance, have no disciplinary violations and whose status as a lawyer has not been suspended or suspended according to the Unified Register of Lawyers of Ukraine.
People’s deputies Yevhen Petrunyak, Oleksandr Danutsa, Oleksandr Bakumov, Roman Babii, Yulia Yatsyk and others were the initiators of the draft law. They emphasized that lawyers are an integral part of the justice system provided for by the Constitution, but are still being neglected in the matter of mobilization.
At the same time, the state has already ensured the reservation of conscripts who work in law enforcement agencies, courts, the justice system and other related structures, granting them a deferment from conscription.
“The mobilization of lawyers has devastating consequences for the entire system of professional legal aid, because there is a significant violation of the legal rights and interests of hundreds of thousands of Ukrainian citizens and legal entities to whom male lawyers provide professional legal aid. In view of this, it is necessary to include lawyers in the list of persons who have the right to receive a deferment from conscription for military service during mobilization” – note the authors of the draft law.
