There are currently no grounds for sanctions against Portnov: Shmyhal

Prime Minister Denys Shmyhal said that there are currently no grounds for imposing sanctions against the former deputy head of Yanukovych’s administration Andriy Portnov. About this it is said in his response to the petition, which the head of the investigation department of Hromadske and the representative of the Media movement Yaroslava Volvach.

“The Ministry of Economy, together with the Ministry of Internal Affairs, the Ministry of Foreign Affairs, the Ministry of Justice, the National Police, the State Security Service, the National Anti-Corruption Bureau, the National Anti-Corruption Bureau, the SBU, and the Office of the Prosecutor General, has been instructed to consider the petition and provide the relevant conclusions. Based on the results of the processing of the said mandate, the Ministry of Economy came to the conclusion that the petition does not contain circumstances that can be considered grounds for the application of sanctions in accordance with the law, while the US decision to apply sanctions is not is a legally defined basis for the application of sanctions”, – said the Prime Minister.

Shmyhal emphasized that the petition lacks data that would testify to Andriy Portnov’s terrorist activity in accordance with the definition of the term “terrorist activity” in Article 1 of the Law of Ukraine “On Combating Terrorism”. Thus, this information cannot be a basis for imposing sanctions in accordance with the law.

“It should be noted that the Ministry of the Economy, the Ministry of Internal Affairs, the National Police, the National Anti-Corruption Bureau, the National Anti-Corruption Bureau, and the Security Service of Ukraine have been notified of the lack of information regarding the existence of grounds for the application of special economic and other restrictive measures (sanctions) to the natural person specified in the petition.

At the same time, in accordance with the Criminal Procedure Code of Ukraine, any interested person who possesses facts that may testify to the commission of a criminal offense has the right to apply to law enforcement agencies with a corresponding statement., – stated in the answer.
