In 88% of cases, Ukrainian courts cancel fines from TCC: what are the most frequent reasons
Ukrainian courts have considered at least 34 cases regarding appeals by Ukrainians against fines from TCCs.

In the three months since the entry into force of the new norms regarding the violation of military accounting rules, as of the beginning of August, at least 34 cases regarding cancellation of fines from the TCC have been found using the court registry search engine. 30 of these cases ended in favor of the plaintiffs and fines were overturned. There is also an appeal of the fine by a woman with a medical specialty in the register. About this informs “opendatab”.
It is noted that Ukrainian courts have considered at least 34 cases with the demand of Ukrainians to appeal fines from the TCC since the introduction of new regulations regarding violations of military accounting rules.
The main reasons for cancellation of fines
“In most of them, namely in 30 cases, the courts ruled in favor of the plaintiffs and canceled the fines. In four cases, the courts rejected the citizens and left the fines in force,” analysts note.
The most popular reasons for canceling fines from TCC:
- The violation occurred before the changes in the law came into force:
- Courts take into account that the law does not have retroactive effect and does not allow punishment for offenses under the new rules.
- For example, in the case where the fine was appealed by a female doctor, the court canceled the fine, because at the time of her education there was no obligation to register.
2. Violation of the prosecution procedure or lack of evidence of the commission of an offense:
In 20% of cases, fines are appealed for these reasons.
For example, a man appealed a fine for not being on military registration, although two weeks before that he received a temporary registration certificate.
- Another case concerns a man who came to the TCC to clarify data and received a fine. The TCC could not prove the commission of an offense and missed the deadlines, which gave grounds for canceling the fine.

Analysts note that it is only about fines for violating the rules of military accounting under the changes in Art. 210 of the Labor Code of Ukraine, adopted in May 2024. Such violations can be fined from UAH 17,000 to UAH 25,000.
