The National Bank proposes changes to the rules for disclosing bank secrecy

The National Bank of Ukraine submitted for discussion the project of amendments to the Rules of storage, protection, use and disclosure of bank secrets. About this reported on the website of the regulator.

The project was developed in connection with the adoption of Law No. 4174-IX “On Amendments to Certain Legislative Acts of Ukraine Regarding Certain Issues of Disclosure of Bank Secrecy and Measures to Establish Guardianship of the Property of a Natural Person Recognized as Missing or a Person Missing in Special Circumstances.”

In accordance with Law No. 4174-IX, the first part of Article 62 of the Law of Ukraine “On Banks and Banking Activity” is supplemented by a new clause 111. This clause gives notaries the right to receive information containing banking secrets in order to take measures to establish guardianship over the property of a natural person who is recognized as missing or disappeared under special circumstances. The law also defines the scope of such information.

“The Project provides for the regulation of the procedure for disclosing information constituting banking secrecy at the request of notaries, officials of local self-government bodies, authorized to perform notarial acts, consular institutions to banks.” – the NBU notes.

The regulator announced that it accepts comments and proposals until March 18, 2025 in the specified form.
