The Verkhovna Rada adopted a law on simplifying the write-off of military property

The Verkhovna Rada of Ukraine adopted draft law No. 12373 in the second reading and as a whole, which provides for the improvement of the management mechanisms and the write-off of military property. The adopted decision simplifies the procedure for writing off property that has become unusable, or was destroyed or damaged as a result of hostilities, informs People’s Deputy Yaroslav Zheleznyak.

The write-off of such property will be carried out by commanders of military units and officials of military administration bodies in accordance with their powers, in accordance with the procedure determined by the Ministry of Defense and other central executive bodies that manage military formations created in accordance with the laws of Ukraine. The marginal value of property that can be written off under one act or in a single copy is 1,700,000 hryvnias.

The document also stipulates that an official investigation to establish the causes and circumstances of the loss, damage, shortage, premature wear, overspending or reduction of the value of military property may not be conducted in the cases provided for by law. In particular, if it is a question of combat damage or actions of the enemy during the performance of combat tasks, the write-off is carried out on the basis of a single act without the need for approval, except for cases related to immovable property.

Single acts for the write-off of military property, the value of which does not exceed 100,000 tax-free minimum incomes of citizens (up to 1,700,000 hryvnias), according to one act, are approved by the commanders of military units.

In the event that the value of property according to a single act is 100,000 tax-free minimum incomes of citizens or more (1,700,000 hryvnias and more), its approval is carried out by commanders or other heads of military administration bodies to which the relevant military units whose property is subject to write-off are subordinate.

An official who has been given a single act for approval is obliged to check the correctness of the document and its compliance with current legislation within 20 days from the moment of receipt. Based on the results of the review, the act can be approved or returned with a reasoned refusal, which must clearly state the reasons and a list of deficiencies that need to be eliminated.
