EBA proposes to change the criteria of the “white business club”

The European Business Association (EBA) proposes to amend the Tax Code of Ukraine in order to simplify the process of including companies in the “white business club”. About this reported EBA press office.
The message states that due to imperfect criteria, some well-known agricultural and telecommunication companies were not included in the list. According to the results of the survey, 46% of companies expressed a desire to join the list of taxpayers with a high level of voluntary compliance with tax legislation, however, they expressed comments about the current selection criteria.
In this regard, the EBA proposes to make a clearer distinction between individual accidental or unconscious errors and intentional violations. In addition, it is proposed to change the criterion for determining the level of tax payment, using a weighted average indicator instead of an arithmetic average.
Also, the business community initiates the establishment of an acceptable level of incomplete settlements within 10% and the possibility of a one-time change of the main type of activity without losing the status of a conscientious taxpayer within 12 months.
EBA member companies have already turned to the Ministry of Finance, the State Tax Service and the specialized Committee of the Verkhovna Rada with a proposal to improve the criteria of the “white business club” and to make appropriate changes to the Tax Code.
We will remind that in 2024, the Verkhovna Rada adopted draft law No. 11084, which defines the list of criteria for including enterprises in the list of taxpayers with a high level of voluntary compliance with tax legislation – the “white business club”.
Members of this list receive a number of benefits, including a moratorium on documentary checks (except in certain cases), shortening the terms of camera and documentary checks for budget reimbursement, as well as receiving individual tax consultations within five calendar days.
