Do teachers have the right to prohibit students from using mobile phones at school
The use of mobile phones in schools has become one of the most debated topics among parents, students and teachers. Smartphones can be both a useful learning tool and a source of distraction that negatively affects children’s discipline and concentration during lessons. In this context, the question arises: can teachers prohibit the use of phones in school, and what are the legal grounds for this?
Can teachers ban phones in school?
From a legal point of view, in accordance with the current legislation of Ukraine, teachers do not have the right to forcibly confiscate students’ phones or demand their handing over before classes, unless this is provided for in the school charter. However, teachers can set rules regarding the use of phones within the educational process, in particular requiring that the gadgets do not interfere with the lesson.
In Ukraine, there is no legal ban on the use of mobile phones in schools, as they are the private property of students. Confiscation of devices without legal grounds may be considered an abuse of authority. However, each educational institution has the right to implement internal rules regarding the use of mobile devices, for example, requiring that the sound is turned off or prohibiting the use of phones without the permission of the teacher during classes.
Therefore, the complete removal of the device is against the law and can be considered as an excess of authority. Students are required to follow the rules of conduct at school, but their right to personal property remains inviolable.
The school’s responsibility for the digital environment
In addition to the use of phones in the classroom, an important aspect is the safety of the digital environment in the educational process. According to the Law of Ukraine “On Education”, educational institutions must provide a safe cyberspace for students, which includes control of access to Internet resources and protection of personal data.
The task of the school administration is to create conditions that will promote effective learning without unnecessary distractions. One of the options for control is the introduction of a policy of limited use of gadgets in schools, which can be implemented by storing phones in specially designated places or allowing them to be used only at certain times.
How to act for parents and students in case of restrictions
If the school implements restrictions on the use of mobile phones, parents can review the relevant internal policies and discuss them during parent-teacher conferences. The main thing is to achieve a balance between the need to maintain discipline and students’ rights to personal property.
Many countries around the world already have certain restrictions on the use of smartphones in schools. For example:
- Belgium, Spain, Great Britain – in some educational institutions, phones are stored in backpacks or lockers and used only when necessary.
- France – in schools it is officially forbidden to use mobile phones during lessons and breaks.
- UK – Research has shown that after restrictions were introduced in schools, pupils’ attainment levels improved by 7%, particularly among those with learning difficulties.
Thus, the issue of using mobile phones in schools remains open and requires a comprehensive approach. Teachers have the right to set rules of conduct within the educational process, but they cannot forcefully remove students’ devices without an appropriate legal basis. The best option is the implementation of compromise solutions at the level of educational institutions, which will allow maintaining discipline in the classroom and at the same time not violating the rights of students to personal property.
