People’s Deputy Tyshchenko again did not come to the court hearing

On January 10, People’s Deputy Mykola Tyshchenko. On January 10, no appeared to the preliminary court hearing in Dnipro in the case of the illegal deprivation of liberty of Dmytro Mazokha, a former officer of the Kraken special unit.

Tyshchenko does not take part in the meeting and did not join it via video link, as he did last time. According to Tyshchenko’s lawyer, the people’s deputy is at a meeting of the Verkhovna Rada and therefore cannot be present.

“It’s funny to me to look at it. He appears in the Verkhovna Rada, and two weeks before that he was taken out on a cart. It’s a shame that we’re taking up time, that we’re going into the media space on this issue, he’s a representative of the people, and he should as no one to fulfill their duties”, — noted ex-military Dmytro Mazokha.

At the previous meeting, Tyshchenko’s lawyer filed a motion to impeach the judge, accusing her of violating the rules. However, Dmytro Mazokha’s lawyer, Ihor Voloshyn, noted that the submission of such motions may be considered by the court as an abuse of procedural rights and delaying the case.

“Applications for the recusal of a judge who directly examines an indictment may be perceived and considered by the judge as a delay, and unreasonable filing of motions on the same grounds, i.e. abuse of one’s procedural right. Therefore, on such grounds, further applications for recusal may be refused.” Voloshyn explained.

The court rejected the motion for recusal. According to the prosecutor, the reason for the statement was the alleged bias of the judge, but no evidence of this was provided. The date of the next meeting will be announced later.
