The case of assigning damages of more than UAH 12 million to “South Ukrainian NPP” has been referred to the court

In 2011-2013, the head of one of the departments of the "Southern Ukrainian NPP" illegally appropriated the funds of the SE "NAEK" Energoatom. 

The prosecutor of the Specialized Anti-Corruption Prosecutor’s Office (SAP) on the basis of the materials of the pre-trial investigation of the National Anti-Corruption Bureau of Ukraine (NABU) sent an indictment to the court against four persons accused of misappropriating the funds of the SE “NAEK “Energoatom” in the amount of more than UAH 12.3 million. informs SAP press office.

Among the accused:

  • The organizer of the crime is the actual head of two bidding companies (Part 3 of Article 27, Part 5 of Article 191 of the Criminal Code of Ukraine);
  • Head of the management of the SE “Southern Ukrainian NPP” (Part 5 of Article 191 of the Criminal Code of Ukraine);
  • Financial director of one of the enterprises (Part 5 of Article 27, Part 5 of Article 191 of the Criminal Code of Ukraine);
  • Head of two legal entities (Part 5 of Article 27, Part 5 of Article 191 of the Criminal Code of Ukraine).

The pre-trial investigation established that in 2011-2013, the head of one of the departments of the “Southern Ukrainian NPP”, using enterprises controlled by the organizer of the crime and acting according to a prior conspiracy with the heads of private companies, illegally appropriated the funds of the SE “NAEK “Energoatom” during the implementation of the “Southern Ukrainian NPP” NPP” procurement of refrigerating and ventilation units, namely industrial air conditioners.

The purchased equipment was purchased at inflated prices, which led to the assignment of losses to the state enterprise in the amount of UAH 12.3 million. The investigation established that the scheme consisted of using enterprises controlled by the criminal organizer to ensure victory in tenders and further inflate the cost of equipment.

In accordance with Part 1 of Art. 62 of the Constitution of Ukraine, a person is considered innocent of committing a crime and cannot be subjected to criminal punishment until his guilt is proven in a legal manner and established by a court verdict.
