Verkhovna Rada Supports Draft Law on Rebooting the Business Inspection System

The Verkhovna Rada of Ukraine supported in the first reading the government draft law No. 5837, which provides for a complete restart of the system of business inspections. This was reported by the Ministry of Economy.
The purpose of the draft law “On the basic principles of state supervision (control)” is to create favorable conditions for the development of small and medium-sized enterprises, as well as to improve the business climate in Ukraine. According to representatives of the Ministry of Economy, this step is part of a large-scale deregulation, which is included in the government’s Strategy for the Development of Small and Medium Businesses (SMEs). The deregulatory approach meets European standards and will contribute to the more efficient operation of enterprises in the conditions of the single market.
First Deputy Minister of Economy Oleksiy Sobolev stressed that the Ministry seeks to change the system of business inspections, replacing a punitive and repressive approach with a preventive and risk-oriented one.
“One of the key goals is to introduce a balanced, transparent system that would guarantee the further formation of a favorable business climate and environment for business development. At the same time, it would protect the interests of the state and people.”, – noted Sobolev.
The main provisions of the draft law:
- Voluntary civil liability insurance for entrepreneurs: this will make it possible to reduce the number of routine inspections for medium and low-risk entrepreneurs.
- Preventive audit of business activities: the business will be able to engage specialists to conduct audits and correct violations without penalties, which will reduce the number of inspections.
- Creation of public councils on issues of state control at authorities: this will increase the transparency of consideration of businessmen’s complaints and contribute to the pre-trial resolution of conflicts.
- Expanding the functionality of the Inspection Portal: this includes the electronic exchange of documents, an e-cabinet for filing complaints, as well as the possibility of refusing a complex inspection through the electronic system.
- Responsibility of heads of supervisory bodies for violation of procedural requirements: disciplinary liability of officials is provided for non-compliance with the legislation.
