Failure to pay a fine from the Transfer Pricing Commission may result in a card being debited or property being confiscated: DOJ
In Ukraine, against the background of mobilization, summonses were sent by mail. According to the new rules, the Cabinet of Ministers determined that citizens have three days to collect the summons from the post office, if it was not delivered personally. If the citizen does not pick up the summons within this period, he may be fined in absentia, and the resolution of the Military Committee (TCC) will be considered an executive document.
According to the legislation, in case of non-payment of the fine, which can be from 17 thousand to 25.5 thousand hryvnias, enforcement will begin. In response to the publication’s request, the Ministry of Justice explained that the decision to impose a fine is submitted to the State Executive Service (SES) at the place of residence or work of the violator, as well as at the location of his property.
The legislation provides that the fine must be paid no later than 15 days after the delivery of the resolution. If a citizen appeals this resolution, the fine must be paid within 15 days after notification of rejection of the appeal.
If the fine is not paid on time, the procedure for forced recovery of funds or property begins. Pursuant to Part 1 of Article 48 of the Law, enforcement of the debtor’s property includes his arrest, withdrawal of funds from accounts or forced sale of property. Seizure of funds or property can be imposed by the executor, in accordance with the decree on the seizure of the debtor’s property.
The priority for recovery is money in national and foreign currencies, and in their absence – other property of the debtor that can be realized in a sufficient amount for the execution of the executive document, including executive fees, costs of executive proceedings and fines.
If the property is jointly owned, recovery is possible only from the share that belongs to the debtor and is determined by the court. At the same time, if the amount of debt does not exceed 20 minimum wages (less than 160 thousand hryvnias), the executors have no right to foreclose on the debtor’s single home and the land plot under it. In this case, the executor looks for other property to foreclose.
