Intruding into housing and not only: what powers will the military police have in Ukraine
The draft law on creation of military police in Ukraine gives it a wide range of powers, including the right to enter the homes of civilians and exercise control over military personnel.
Home invasion:
Military policemen will be able to enter citizens’ homes without their permission only in two cases:
- If there is reason to believe that a person who has committed a crime is hiding in the premises, the military police will have the right to enter for the purpose of arrest.
- In the event of an urgent need to prevent a threat to the life, health or property of citizens, the military police will also be able to enter the dwelling without permission. After such actions, the police officers are obliged to immediately inform the investigator and the prosecutor.
Control over the military:
The military police will be responsible for maintaining discipline and law and order among military personnel. She will have the right to:
- The new police will be able to check documents of military personnel of any formation, conduct personal searches and inspect vehicles.
- The police will be able to detain military personnel who are under the influence of alcohol or drugs, as well as those who violate traffic rules.
- Military personnel who have committed disciplinary offenses can be detained at guardhouse.
