Secrecy of court decisions in the Register: Parliament approved the draft law in the first reading
Today, May 23, the Verkhovna Rada approved in the first reading, draft law No. 7033-d, which may significantly limit the public’s access to court decisions regarding mobilization and military service.
The main changes:
- Courts will have the right to close “sensitive” information in the Unified State Register of Court Decisions, as well as independently determine which decisions should not be disclosed.
- Until the second reading, it is planned to close access to decisions on sanctions for non-fulfillment of military duty.
- The draft law provides for the closure of information about critical infrastructure objects, including election commissions, mass media, courts and state authorities.
- Decrees on seizure of property and temporary access to things and documents have been added.
The draft law also provides for the closure of names of critical infrastructure facilities. This list, in accordance with the Resolution of the Cabinet of Ministers of 16.12.22 No. 1384, may include not only election commissions, mass media, courts and state authorities, but also objects involved in the organization of elections and referenda, local self-government bodies, pension institutions security, social insurance and social services, as well as financial institutions.
The Committee on Legal Policy of the Verkhovna Rada considers it necessary to take into account the recent changes to the legislation on mobilization, which entered into force on May 18, during the preparation of the draft law for the second reading.
