The AMCU fined a cosmetic gel manufacturer UAH 240 thousand

The Antimonopoly Committee of Ukraine has found that Euro Plus violated the law and misled consumers. This was reported by the AMCU press service.

According to the report, the company placed false information on the packaging and tube of Ibuprozan Baum Pharm cosmetic gel, indicating that it ‘eliminates inflammation and pain in joints and muscles’, ‘has a strong analgesic and anti-inflammatory effect, reduces swelling and pain, including arthritis and low back pain’.

However, according to the Ministry of Health of Ukraine, the claimed properties of the product have a pharmacological effect.

The AMCU also imposed a fine of UAH 12 million on two companies for collusion in the bidding process.

A product positioned as having the above properties cannot be classified as a cosmetic, as such products fall under the Law of Ukraine ‘On Medicines’ and must be included in the State Register of Medicines of Ukraine,’ the AMCU said. The agency also said it had not received confirmation of the claimed properties of Ibuprozan.

The information about the properties of this cosmetic product on the tube and packaging of this cosmetic product could have influenced the intentions of consumers to purchase such products, and therefore the company could have strengthened its competitive position and gained undue competitive advantage over other business entities,’ the AMCU stressed.

Euro Plus PE was fined UAH 240,000. According to the AMCU, the company acknowledged the violation, stopped it and cooperated with the agency during the proceedings.
