The Cabinet of Ministers submitted to the Verkhovna Rada a draft law on simplifying the procedure for repairing energy facilities

The Cabinet of Ministers has submitted to the Verkhovna Rada a bill proposing to simplify the procedures required for the reconstruction and overhaul of energy infrastructure. The relevant information is published on the parliament’s website.

The bill No. 14115 provides for the possibility of carrying out such work on lands of state or municipal ownership without registration of property rights. In particular, it is about the abolition of requirements for state registration of the right to use a land plot, the development of land management documentation and entering information into the State Land Cadastre.

The only condition for this will be the approval of the executive authority or local government that manages the relevant land. To obtain such approval, the critical infrastructure operator must submit a corresponding notification with all necessary materials. The relevant authority is obliged to provide a response within 10 working days.

If the response is not received within the established period, it is proposed to grant the operator the right to begin work without approval, subject to written notification to the authority. After the end of the martial law or state of emergency, operators will be required to register property rights to the land in accordance with current legislation.

In addition, it is proposed to amend the Law “On Regulation of Urban Development Activities” to allow for the reconstruction and overhaul of critical energy infrastructure facilities without the right to own or use the land plot – for the duration of the martial law or state of emergency, as well as within one year after its end.

It is expected that the implementation of this draft law will contribute to the creation of new jobs, an increase in the revenues of local budgets and funds, as well as an increase in the level of security and stability of energy facilities under martial law.
