The court closed the case on the division of the Poroshenko couple’s property
Kryzhopol District Court in Vinnytsia Region closed proceedings in the case of Maryna Poroshenko’s lawsuit against Petro Poroshenko regarding the division of property, citing the absence of a subject of dispute. The defense of the spouses intends to appeal this decision.
During the session, the court attached to the case file a letter from the Ministry of Justice, which referred to the sanctions imposed on Petro Poroshenko.
“The content of the letter indicates possible objections of the Ministry of Justice, which formally do not exist”, – noted lawyer Ilya Novikov.
He asked the court not to consider this document as an official objection. Maryna Poroshenko’s representative emphasized that her client has the right to a share of the property acquired in marriage, as she herself is not subject to sanction restrictions.
In response, Ilya Novikov offered to make a decision already at the preparatory meeting, since “the defendant does not deny the demands.” However, judge Larisa Shvets decided to stop the proceedings due to the lack of a subject of dispute. In addition, the court ordered the State Treasury Service to return 15,640 hryvnias of court fees to Maryna Poroshenko.
The resolution also contains a ban on re-applying to the court with a claim between the same parties and on the same subject. After the meeting, Ilya Novikov called the resolution legally unfounded.
“The judge ruled that there is no subject of dispute between Maryna and Peter Poroshenko. We consider this to be legally incorrect. The subject of dispute exists when a claim is filed in accordance with the law.” he emphasized.
The lawyer explained that the case is not related to the concealment or re-registration of property. The bottom line is that due to the sanctions, Petro Poroshenko cannot transfer his share to Marina, who has no restrictions. It was for the purpose of protecting her right that the lawsuit was filed.
“This is not the final. We have a plan B. If it doesn’t work, there will be a plan C. We are ready to defend ourselves further.” – concluded the lawyer.
