The Supreme Court upheld the first establishment of a de facto marital relationship between two men in Ukraine
The Supreme Court of Ukraine upheld the decision to establish de facto family relations between two men — First Secretary of the Embassy of Ukraine in Israel Zoryan Kis and his partner, public activist Timur Levchuk. This is the first such case in the country’s judicial practice. This was reported by the public organization “Insight”.
The court rejected the cassation appeal of the public movement “All Together”, whose representatives explained their participation in the case by the provisions of their own charter. In particular, one of the organization’s goals is to “prevent the legalization of same-sex marriages and partnerships in Ukraine.”
The Supreme Court noted that the decision cannot be appealed by an organization that was not a party to the case and whose rights or obligations are not affected by this decision.
Thus, the court confirmed the decision of the previous instance, which for the first time in Ukraine established the fact of family relations – cohabitation as one family – between two men without official registration of marriage.
“This is a colossal precedent. No homophobic or conservative organization will be able to use the courts as a tool to persecute or overturn decisions in favor of LGBTI+ people, under the guise of “public morality.” The state has protected the boundaries of private life,” the organization noted.
In July 2025, the Desnyanskyi District Court of Kyiv recognized the de facto family relationship between Zoryan Kis and Timur Levchuk. After Kisya was appointed First Secretary of the Embassy of Ukraine in Israel, he was supposed to go on a long trip abroad.
However, the Ministry of Foreign Affairs of Ukraine refused to allow his partner to travel with him, citing legislation that defines marriage as a union between a woman and a man.
After that, the diplomat went to court with a request to officially establish the fact of living together as one family without registering the marriage, which was confirmed by the court decision.
