Ukrzaliznytsia explained who has the right to the bottom shelf and a table in the compartment
A trip in a compartment car often turns a few square meters into a shared space, where comfort depends on the ticket, agreements between passengers, and the willingness to respect the boundaries of neighbors. Disputes arise in everyday situations: over luggage, access to a table, the opportunity to sit during the day or eat quietly during a long journey. After the conflict on the Chop – Kyiv train, Ukrzaliznytsia employees explained how the rules work in such cases and why the purchased seat determines the scope of a passenger’s rights.
The incident became known after a post in Threads. Two women returning from a symposium in Prague and having tickets for the upper shelves asked their neighbors from the lower seats to let them sit at a table to have breakfast. The girls, who were traveling from the bottom, refused to give up their space and referred to the travel rules, according to which the lower shelves and the place below them are reserved for passengers who have paid for the appropriate tickets.
According to Ukrzaliznytsia employees, the owners of the lower seats in such a situation acted within their rights. The lower shelf belongs to the passenger who purchased a ticket for it throughout the trip, so other people in the compartment can use it only with the consent of the seat owner. The same principle applies to the luggage locker: the space under the lower shelf is provided for the belongings of the passenger from the lower seat, while passengers of the upper shelves must place their luggage in the places provided for them above.
Ukrzaliznytsia explained that the difference between the upper and lower seats is related to the level of comfort that the passenger chooses when buying a ticket. The lower shelf is usually more comfortable for a long journey, daytime stay, access to a table and placement of things, so the right to use it is guaranteed to the person who paid for the corresponding seat. Passengers from the upper shelves can ask their neighbors to sit below or use a table, but this possibility depends on the voluntary consent, and not on the obligation of other passengers.
In a specific case, women from the upper seats, according to the description of the situation, were unable to agree with their neighbors and were forced to have breakfast and spend part of their time in the corridor of the carriage. The carrier’s employees actually confirmed that the rules do not oblige passengers from the lower shelves to give up their seats for a meal, even if the request seems understandable or the situation lasts for several hours.
The position of Ukrzaliznytsia employees boils down to a simple principle: there is a common space in the compartment, but each berth has a specific owner for the duration of the trip. The table is located near the lower shelves, but access to it does not automatically give the right to sit in someone else’s seat. Because of this, the comfort of passengers from the upper shelves largely depends on agreements with neighbors, and conflicts arise when expectations of mutual courtesy clash with the literal application of the rules.
Ukrzaliznytsia employees also made it clear that passengers should take these nuances into account even at the stage of planning the trip. If it is important for a person to have free access to a table, to sit downstairs during the day, to eat comfortably, or to place luggage in a locker, the lower seat should be selected when purchasing a ticket. The upper shelf remains a legal and full-fledged place for travel, but it does not guarantee the use of the space that is reserved for the neighbors below.
