A lawsuit was filed against Ukrenergo for UAH 6.5 billion

The state-owned enterprise “Guaranteed Buyer” filed a lawsuit against PrJSC NEK “Ukrenergo” with a demand to collect UAH 6.5 billion in debt for payment of services related to renewable energy sources (RES). This information made public edition of ExPro, referring to the materials of the court case.

The commercial court of the city of Kyiv has already accepted the claim for consideration and opened the relevant proceedings. According to the decision published in the Unified Register of Court Decisions, the lawsuit was submitted to the court on September 18, 2024.

The main amount of the debt to be recovered is UAH 5.8 billion and refers to debt for services to ensure an increase in the share of electricity production from alternative sources for the periods of September-November 2022, March-June 2023, and October-November 2023. In addition to this amount, UAH 284.9 million in the form of 3% annual and UAH 418.8 million of inflationary losses are included.

According to ExPro, as of September 1, 2024, the level of payments by the “Guaranteed Buyer” under the “green” tariff for different periods is as follows: 99.7% for 2021, 61.2% for 2022, 90.5% for 2023 year, and 63.4% for 2024. At the same time, the total debt of “Ukrenergo” to SE “Guaranteed Buyer” for RES services reached UAH 28.44 billion.

The critical situation with debts on the energy market remains a problem for many participants, in particular for preparing for the autumn-winter period. Energoatom’s debt to the “Guaranteed Buyer” is UAH 12.4 billion, and the debts of the “Guaranteed Buyer” itself to universal service providers have reached UAH 12.3 billion, and to producers of alternative energy sources exceed UAH 34 billion.
