After changing gender, man successfully obtained exemption from military service through court
A court in Kharkiv made a decision to exclude from military service a person who changed gender from male to female. Previously, the Territorial Center for Recruiting and Social Support refused to deregister her, but the Kharkiv District Administrative Court found such a refusal unlawful.
The plaintiff appealed to the court with a demand to recognize the actions of the TCK regarding the refusal to exclude her from the registration of military conscripts as unlawful and to oblige her to make changes to the Unified State Register of Conscripts, Military Conscripts and Reservists “Oberig”.
She provided a medical certificate on the change (correction) of gender and documents on making changes to the civil status record. According to them, in January 2025, the sex was officially changed, after which the woman received a new passport.
Despite this, the CCC informed her that in order to be removed from military registration, she must undergo a military medical examination. The court concluded that such a requirement was unfounded and ordered the plaintiff to be removed from military registration and the “Oberig” registry, emphasizing that women serve in the military on a voluntary basis.
