Is it possible to take a child abroad without the permission of one of the parents in 2024

The procedure for children to travel abroad in the conditions of prolonged martial law has become simpler, because if the child travels with one of the parents or relatives, the rules are simplified, but for traveling with a third person, additional documents are required

In 2024, the rules for crossing the Ukrainian border with children remain relevant for many families. According to the law, children under 16 can travel abroad only when accompanied by an adult with appropriate documents. During the martial law, which continues from February 24, 2022, for a child to leave with one parent or guardian, notarized consent of the second parent is not required, it is enough to have the original birth certificate of the child.

If the child is traveling with close relatives (grandmother, grandfather, stepmother, stepfather or an adult brother or sister), the accompanying person must have the original birth certificate of the child and documents confirming family ties.

If the child goes abroad with a third person who is not a relative, a written statement from one of the parents, certified by the guardianship authority, or a notarized permission for the child to go abroad, as well as the original birth certificate of the child, his foreign passport (if any) is required ) and an adult’s international passport.

To travel abroad with a child under the age of 16, the following documents are required:

  • Passport for traveling abroad of the mother or father (of the person traveling with the child);
  • Child’s foreign passport (if any) or child’s birth certificate.

To some countries, children over the age of 14 can travel with ID cards, for example, to Turkey or Georgia, and children over the age of 16 can leave Ukraine independently.

Men who independently raise at least one child under the age of 18 can cross the Ukrainian border during martial law and mobilization. To do this, you need to provide the border service with a package of documents, which includes:

  • Birth certificate of the child(ren);
  • Documentary confirmation that the child is being raised by one parent (father), which can be in the form of:
  • Death certificates of the child’s mother;
  • Court decision to deprive the mother of parental rights;
  • The court’s decision to recognize the missing mother as missing;
  • The court’s decision to declare the mother dead.

In some cases, a court decision may establish the fact of taking a child away from the mother without depriving her of parental rights.

  1. Biometric passport: From 2024, all children, regardless of age, can get a biometric passport, which facilitates travel and speeds up the process of crossing the border.
  2. Electronic exit permit: A system of electronic permission for children to travel abroad has been implemented, which allows you to issue the necessary documents online without visiting a notary.
  3. Foreign visas: Some countries have simplified visa requirements for Ukrainian children traveling with a parent or legal guardian to facilitate evacuation and humanitarian assistance.
  4. Accompaniment during the trip: Some airlines offer escort services for children traveling unaccompanied, providing extra security and convenience when crossing the border.
  5. International aid: Many international organizations provide advice and assistance to Ukrainian families on the issue of children moving abroad during martial law, including legal support and provision of temporary housing.
