Military inventors will be paid a fee for their developments: Ministry of Defense

Military personnel who create technological solutions for the army will receive the right to fair royalties, and the state will be able to scale these developments more efficiently. About this informs press service of the Ministry of Defense.

Currently, military personnel of scientific institutions, specialized technological centers, technical workshops and other units of the Defense Forces are working every day to create solutions that help destroy the enemy. However, unlike the civilian sector, intellectual property rights to these developments remain unprotected.

To solve this problem, the Verkhovna Rada of Ukraine registered two draft laws No. 13110 and No. 13111 on amendments to the Civil Code of Ukraine and related laws. They provide that personal non-property rights, including authorship and the right to preserve the integrity of the work, will belong to the serviceman-author or inventor of such an object. At the same time, property rights for use and licensing will be obtained by the state in the person of the Ministry of Defense or another body where the author is serving.

Adoption of these changes will ensure that the military is fairly rewarded for the intellectual property they create and will remove barriers to scaling technology solutions, as the Ministry of Defense will have clear licensing authority.

“In conditions where technologies are created, tested and improved on the battlefield, the protection of intellectual property rights is one of the priorities for the country’s defense capability. The Ministry of Defense is committed to ensuring a fair reward for those who, with their intelligence and talent, create a technological advantage on the front, protect the rights to these developments and ensure their scaling.”, – noted Deputy Minister of Defense Valery Churkin.

Draft laws were developed by the Intellectual Property Department of the Main Directorate of Military Justice, the Ukrainian National Office of Intellectual Property and Innovation, and the Institute of Law-Making and Scientific-Legal Expertise of the National Academy of Sciences of Ukraine. The proposed changes will be the first step in updating the regulatory framework for intellectual property in the military.
