NAAU offers to reserve 25% of lawyers and representatives of other professional organizations

The National Association of Lawyers of Ukraine developed and presented two draft laws aimed at protecting lawyers, notaries, arbitration managers and private executors from mobilization. The relevant laws were prepared by a working group (Deputy Chairman of NAAU, RAU Valentyn Gvozdiy, members of RAU Oksana Kadenko and Hanna Lazarchuk).

Establishing the number of conscripted members of the specified organizations, which are subject to reservation for the period of mobilization and wartime, in a ratio of no more than 25% of the total number of conscripted members of each of the specified organizations“, the lawyers note.

Key provisions of the draft laws:

  • Amendments to the Law of Ukraine “On Mobilization Training and Mobilization”: it is proposed to supplement Article 25 of this law by including in the list of persons subject to booking, members of non-state non-commercial professional organizations, such as NAAU, the Notary Chamber of Ukraine,
  • National Association of Arbitration Managers of Ukraine and Association of Private Executors of Ukraine.
    Amendments to Resolution No. 76 of the Cabinet of Ministers of Ukraine: It is proposed to add to the list of enterprises, institutions and organizations critically important for the functioning of the economy and ensuring the livelihood of the population, non-state non-commercial professional organizations representing the interests of lawyers, notaries and other legal professionals.

NAAU emphasizes that lawyers, notaries, arbitration managers and private executors play an important role in ensuring law and order, protecting the rights and interests of citizens and businesses. Their mobilization can lead to serious problems in access to justice, violation of human rights and destabilization of the economic situation.

The project of legislative changes has already received the support of the Bar Council of Ukraine. NAAU plans to send these documents to the Verkhovna Rada and the Cabinet of Ministers of Ukraine for their speedy consideration and adoption.

The Cabinet of Ministers must establish the criteria and procedure for booking members of non-state non-commercial (non-profit) professional organizations.
