The government has adopted a decision to simplify regulations in the field of construction and reconstruction

The Cabinet of Ministers adopted a package of decisions aimed at simplifying regulations in the construction sector and accelerating reconstruction. This was announced by Prime Minister Yulia Svyrydenko.

According to her, the government is beginning a systemic deregulation for business, and the first stage will be changes in the field of urban planning.

“Today, the government adopted an important package of decisions to simplify construction regulation and accelerate reconstruction. Fewer unnecessary procedures and clear work rules are the most frequent requests we hear from entrepreneurs across the country,” she said.

Svyrydenko noted that businesses often complain about long deadlines and the lack of a real choice of where to receive services to start construction projects works.

The government is launching an experimental mechanism under which the construction customer will be able to choose where to receive administrative services: at a local authority or at the State Inspectorate for Architecture and Urban Planning of Ukraine.

According to Svyrydenko, the goal of this decision is to create an alternative in the system and speed up the processing of documents. In addition, the government is introducing a mechanism for appealing against refusals to provide urban planning conditions and restrictions.

“Today, even a formal or unfounded refusal can stop a project for months. From now on, such decisions can be appealed to DIAM,” the head of government said.

If the refusal is recognized as unfounded, the customer will be able to continue designing in compliance with the requirements of urban planning documentation. In this case, the project will no longer be blocked due to formal decisions. The Ministry of Development and the Ministry of Justice were instructed to urgently prepare and submit a draft law that would set clear deadlines for appealing decisions in the construction sector.

Svyrydenko stated that these decisions are part of a comprehensive urban planning reform. The next stage should be legislative changes, in particular regarding spatial planning of communities and ensuring legal certainty in construction.
