The Government of Ukraine changed the Procedure for maintaining the State Land Cadastre
The Cabinet of Ministers of Ukraine adopted changes to the Procedure for maintaining the State Land Cadastre. The relevant resolution “On Amendments to Resolution No. 1051 of the Cabinet of Ministers of Ukraine dated October 17, 2012” was adopted at the government meeting on September 10.
The document changes the mechanism for considering applications for entering information or changes to them in the State Land Cadastre, as well as the procedure for checking the attached documents. The new rules are brought into line with the Law of Ukraine “On Administrative Procedure”.
The adopted changes are aimed at creating a clear and transparent system of interaction between the state and citizens in the field of land relations. They are designed to make the process of submitting and considering applications more understandable, and the deadlines for making decisions predictable for businesses and citizens. It is expected that this will reduce the number of delays and reduce administrative costs, because from now on, deficiencies in submitted documents can be corrected without the need to resubmit the entire package “from scratch”.
According to the adopted changes, several innovations are foreseen. First, it is allowed to accept even an incomplete package of documents for consideration. Second, the application is subject to registration regardless of whether it contains errors made by the applicant. Thirdly, the cadastral registrar received the right to make a decision to leave the application without movement, informing the applicant about the identified deficiencies and ways to eliminate them. The procedure for making positive decisions on entering information or changes to it in the cadastre has also been introduced. In addition, new forms of documents are defined, which are formed during the consideration of submitted applications.
In fact, we are talking about the transition to a modern model of land administration, which brings the work of the cadastre closer to European standards. The government expects that the implementation of these rules will contribute to better protection of the rights of citizens and businesses, increase the efficiency of land management and reduce the risks of abuse at the level of executors. This also creates conditions for greater digitalization of the sphere, because new forms of documents and clear administrative procedures will allow the development of electronic services and reduce the bureaucratic burden.
