The Ministry of Defense approved the criteria for determining defense industry enterprises as critically important for the economy

The Ministry of Defense of Ukraine approved the criteria by which enterprises, institutions and organizations in the field of the defense-industrial complex, aircraft construction and space activities will be determined as those that are of importance for the national economy.

Accordingly, the defense department has officially begun accepting documents from enterprises to grant them the appropriate status. Applications are accepted at the e-mail address [email protected]. Until now, these functions were performed by the Ministry of Strategic Industries of Ukraine.

The new criteria, approved by order of the Ministry of Defense, retain the previous approach to determining such enterprises. Business entities that already have the status of an enterprise of importance for the national economy and its validity period has not yet expired do not need to take any additional actions or make changes to the documents.

Enterprises of the defense-industrial complex that apply for the status of an enterprise of importance for the national economy and, accordingly, may receive the right to reserve up to 100% of military-liable employees must meet the following conditions:

• fulfillment of a state contract (agreement) in the field of defense or participation in its implementation, in particular under foreign economic agreements;
• the share of defense production must exceed 50% of the total volume for the last reporting period;
• receipt of state financial support in the form of grants in accordance with the Resolution of the Cabinet of Ministers of Ukraine dated March 8, 2024 No. 262 “Some issues of ensuring the development of innovations and technologies for the needs of defense”;
• performance of the functions of an authorized entity for the management of state-owned objects, which regulates, controls and coordinates the activities of defense industry enterprises.

Enterprises, institutions or organizations that do not meet the specified criteria may receive the status of important for the national economy provided that they meet at least three of the following requirements: participation in the execution of state defense contracts, involvement in defense orders (including foreign economic ones), inclusion in the electronic register of selection participants and executors of state contracts, participation in the implementation of state target programs in the fields of aircraft construction or space activities, participation in programs for the development of the defense-industrial complex, the introduction of new technologies or the expansion of production capacities, as well as in the production of goods or the provision of services used by defense industry enterprises to manufacture defense products.

If the enterprise meets at least two criteria of the Resolution of the Cabinet of Ministers of Ukraine dated January 27, 2023 No. 76 “Some issues of implementing the provisions of the Law of Ukraine “On Mobilization Training and Mobilization” regarding the reservation of military personnel for the period of mobilization and for wartime”, it can be defined as critically important for the functioning of the economy and ensuring the livelihoods of the population in a special period, which will allow booking up to 50% of military personnel.
