The NACP has improved the clarification on conflict of interest

The National Agency for the Prevention of Corruption (NACP) has updated methodological recommendations for the application of certain provisions of the Law of Ukraine “On Prevention of Corruption”, which relate to the settlement of conflicts of interest and compliance with anti-corruption restrictions. About this informs press service of the NAKC.
Updates focus on issues of conflict of interest arising from the joint work of close persons and when resolving issues of remuneration, as these aspects often cause difficulties for public servants. The methodological recommendations now consider in detail the situations when relatives work in the same state body or at a state or communal enterprise.
Four typical cases of potential conflicts of interest are described, and new examples are provided with explanations, including recruitment, working under the direction of a close person and bonuses under external control.
Added a separate section dedicated to conflicts of interest in matters of remuneration. It explains the various situations that may arise when awarding incentive payments, dividing them into cases where a conflict of interest is present and when it is not.
Specific examples are also given that help to understand whether a conflict of interest arises, for example, when initiating the establishment of additional payments for oneself or a manager or when making a decision on bonuses in consultation with the relevant authorities.
Updated methodological recommendations available in the NAKC knowledge base in the “Conflict of Interest” section and in the form of a manual. At the same time, the changes do not introduce new rules, but are only intended to improve the understanding of public servants in this area through the expansion of practical examples.
