The National Bank submitted for discussion amendments to the Rules for the storage, protection, use and disclosure of the secrecy of the payment service provider

National Bank of Ukraine brought out for discussion of the draft amendments to the Rules of storage, protection, use and disclosure of the payment service provider’s secret.

The document proposes to provide individuals and legal entities, both clients and owners of information, with the opportunity to sign requests (permits) for the disclosure of information constituting the payment service provider’s secret in electronic form. For this, the use of a qualified electronic signature created in accordance with the requirements of the Regulation on the use of an electronic signature and an electronic seal is provided.

The proposed changes are designed to unify the approaches to the preparation of written requests and permissions for the disclosure of information that belongs to the payment service provider’s secret. They must be consistent with the regulations set forth in the Financial Services Privacy Policy and the Insurance Privacy Policy. The NBU will accept comments and proposals for this project in the established form until August 29, 2025.

We will remind you that on July 11, the National Bank updated the rules for monitoring compliance with legislation in the field of protecting the rights of consumers of non-financial payment services. The changes are consistent with the provisions of the Law “On Payment Services”, which entered into force on August 1, 2025. Corresponding corrections have been made to the Regulation on Supervision, which regulates the procedure for the National Bank’s control over the interaction of market participants with consumers and its response to possible violations of their rights.
