European Business Association positively appreciated the adoption of Resolution No. 650, which provides for the possibility of booking employees both through the Diya portal and through the traditional way of submitting documents to the relevant authorities.
In its statement, the EBA emphasized that it supported the initiative of the Ministry of Economy to implement electronic booking, which will significantly speed up the process. At the same time, the Association was in favor of preserving the existing procedure in order to avoid problems in the event of malfunctions in the new system.
Key changes introduced by Resolution No. 650
- The period of validity of the postponement has been increased to 1 year.
- Possibility to book conscripts regardless of their military rank and military accounting specialty.
- A more flexible approach to limiting the reservation of 50% of conscripts.
- The ability to book not only employees, but also ultimate beneficial owners and members of supervisory boards of strategically important enterprises.
- Removal of the 50% limit for enterprises of the fuel and energy complex, emergency recovery works and the military-industrial complex.
Issues that require further resolution
Conflict between the new law on mobilization and the updated Regulation 76 on the registration of deferment.
Absence of liability of TCC and JV for non-fulfillment of deadlines for placing on special account.
Absence of a mechanism for booking employees of foreign representative offices. The EBA is preparing official proposals to resolve these issues. The association expresses hope for a quick launch of the new reservation mechanism in “Diya” and further dialogue with the authorities regarding the improvement of business conditions in Ukraine.
