The Verkhovna Rada is preparing new penalties for employees of the CCC and VLK for violating mobilization
The Verkhovna Rada Committee on Law Enforcement Activities recommended adopting draft law No. 12442 in its entirety. It provides for criminal liability for employees of the CCC and doctors of military medical commissions for violating the mobilization procedure. This was reported by the press service of the Verkhovna Rada.
The document proposes to introduce criminal punishment for representatives of the CCC and doctors of the Military Medical Commission for violating the procedure for conscription and military medical examination during martial law. Such actions may be punishable by 3 to 8 years of imprisonment.
The explanatory note notes that the bill was prepared due to the ongoing armed aggression of the Russian Federation against Ukraine and the need to ensure general mobilization. Its purpose is to strengthen the criminal liability of officials of territorial recruitment and social support centers and members of military medical commissions for violating legislation in the field of defense and mobilization.
The basis for the legislative initiative was the violations identified during mobilization measures. These include the conscription of people who were not subject to mobilization, the illegal granting of deferments, improper response to draft evasion, as well as violations of the procedure for medical examinations in the Military Medical Corps. Such actions violate the rights of citizens and negatively affect the manning of the Defense Forces.
Amendments to the Criminal Code of Ukraine should clearly define responsibility for these offenses, ensure legality during mobilization, and increase trust in state institutions.
The draft law proposes to supplement the Criminal Code with two new articles — 337-1 and 426-2. Article 337-1 provides for responsibility for violating the procedure for conducting a medical examination, or military medical examination, to determine the suitability of citizens for military service. The punishment will apply to the heads and members of the Military Commission in case of intentional violations that led to illegal conscription, illegal evasion or dismissal from service.
Article 426-2 establishes liability for officials of the CCC and the SP for violating the procedure for conscription of citizens for military service, if this led to illegal conscription or evasion from service.
Legal regulation of this area is already carried out by the Constitution of Ukraine, the Criminal Code, the laws “On Mobilization Training and Mobilization”, “On Prevention of Corruption” and other regulatory legal acts.
It is expected that the draft law will create a more effective legal a mechanism for investigating violations in the field of mobilization, will strengthen the responsibility of officials of the CCC and members of the VLK and promote compliance with the rule of law during defense measures.
